Terms & Conditions

By booking and using the services of Unwind Sports Recovery (Pty) Ltd (“Unwind”), you acknowledge, agree to, and accept the following terms and conditions:

1. Acceptance of Terms

By proceeding with any booking, consultation, or treatment with Unwind, you confirm that you have read, understood, and accepted these Terms & Conditions in full. If you do not agree to these terms, you must not use our services.

2. Assumption of Risk & Release of Liability

You acknowledge that all treatments, therapies, and services offered by Unwind carry inherent risks, including, but not limited to, physical injuries, adverse reactions, illness, or aggravation of existing conditions. You voluntarily assume all such risks. To the fullest extent permitted by law, you agree that Unwind, its owner, directors, staff, and agents shall not be liable for any injury, loss, damage, or expense sustained during or as a result of using our services, except in cases of proven gross negligence or wilful misconduct.

3. Medical Treatment Disclaimer

All treatments offered by Unwind are complementary and supportive in nature and are not a substitute for medical diagnosis, treatment, or advice from a qualified medical professional. No guarantees regarding results, improvements, or outcomes are provided. In the case of a medical emergency, you authorize Unwind to seek medical assistance at your cost. It is your responsibility to inform us of any pre-existing medical conditions, injuries, allergies, or medications prior to treatment. Failure to disclose such information may void any liability on the part of Unwind.

4. POPIA & Digital Communication Consent

In terms of the Protection of Personal Information Act (POPIA), 2013, you consent to the collection, storage, and processing of your personal information provided during the booking and treatment process, including but not limited to your name, contact information, medical history, and treatment notes.
You consent to receiving communications from Unwind via email, WhatsApp, SMS, or phone for purposes including, but not limited to:

• Appointment confirmations and reminders
• Updates on services, promotions, or events
• Important health, safety, or administrative notices

Your personal information will be handled securely and will not be shared with third parties without your explicit consent, except where required by law. You may request access, correction, or deletion of your personal information by contacting us at Immanuel@unwindsportsrecovery.co.za.

5. Client Conduct & Professional Boundaries

Unwind provides professional, non-sexual, therapeutic services. Any conduct that is deemed inappropriate, offensive, or abusive may result in immediate termination of the session, with full payment still due.
Clients must follow all instructions provided by therapists to ensure safety during treatments.

6. Cancellations & Rescheduling

Appointments may be cancelled or rescheduled via the email confirmation, WhatsApp, or direct email at least 24 hours prior to the scheduled appointment.

• Late cancellations or no-shows: A 50% fee of the scheduled session applies, unless valid proof of an emergency is provided.
• Rescheduling due to emergency situations will be handled at the discretion of Unwind.

7. Payment & Pricing

All fees are payable in full at the time of booking or as agreed in advance. Prices may change without prior notice but will not affect bookings already confirmed.
Unwind reserves the right to suspend services in case of non-payment or fraudulent transactions.

8. Legal Jurisdiction & Liability Limitation

This agreement is governed by the laws of the Republic of South Africa, and any disputes shall be resolved exclusively in South African courts.
To the maximum extent permitted by law, Unwind's liability, if any, shall not exceed the fees paid for the specific service or session in question.

9. Indemnification

You agree to indemnify and hold harmless Unwind, its staff, agents, and directors against any claims, liabilities, damages, or expenses arising from your use of services, violation of these Terms, or failure to follow the therapist's instructions.

10. Amendments

Unwind reserves the right to update or modify these Terms & Conditions at any time, without prior notice. Updated terms will be effective immediately upon publication on the website or via communication to clients. Continued use of services constitutes acceptance of the updated terms.

By booking a session, you confirm that you have read, understood, and accepted these Terms & Conditions, including the collection and processing of your personal information under POPIA.

• Important health, safety, or administrative notices

3. Data Protection

Your information will be stored securely and will not be shared with third parties unless required by law. You have the right to request access, correction, or deletion of your information at any time.

4. Acknowledgment & Agreement

By booking a session with Unwind, you confirm that you have read, understood, and agreed to how your personal information will be used and stored under the Protection of Personal Information Act (POPIA), 2013.
